Judge Dismisses Lawsuit Against Nirvana

A federal judge dismisses a case against rock band Nirvana.

According to a report from Pitchfork, Judge Fernando Olguin of the United States District Court for the Central District of California decided the case should be dismissed with prejudice.

According to the lawsuit filed by 31-year-old Spencer Elden, the 1991 Nevermind album cover by Nirvana, which features a picture of Elden as a newborn naked in a pool, constitutes child pornography.

Judge Olguin dismissed the case after concluding that the lawsuit had been filed more than ten years earlier. Elden is permitted to appeal the decision, despite the fact that Elden cannot re-file, according to Judge Olguin’s decision.
